(“Orange”, “we”, “our” or “us”) on the collection, use and disclosure of your information, whether you are a visitor to our website, an owner or operator of an electric vehicle charging station using Orange charging devices and software platform (a “Charging Location” and such owner or operator an “Owner”), a user of our mobile application(s), online portal, or other websites, applications or services we offer to enable you to use such charging locations (any such user a “Driver”), a user of an Account (as defined below), or a user of any other website, application or service offered by Orange that includes a link to this Privacy Policy (such websites, services and applications collectively, the “Service” and any such individual accessing or using the Service, or the company or other legal entity on behalf of which such individual is accessing or using the Service, as applicable. “You” or “Your”). By using any part of the Service, You agree to the collection, use and disclosure of information in accordance with this Privacy Policy.

Definitions

Capitalized terms used in this Privacy Policy have the meaning assigned to them in this Privacy Policy.  In addition to the capitalized terms defined elsewhere in this Privacy Policy, the following capitalized terms will have the meaning set forth below for the purposes of this Privacy Policy:

“Account” means a unique account created for You to access the Service or parts of the Service.

“Cookies” are small files that are placed on Your computer, mobile device or any other device by a website, containing the details of Your browsing history on that website among its many uses.

“Device” means any device that can access the Service such as a computer, a cell phone or a digital tablet.

It refers to third-party companies or individuals employed by Orange to facilitate the Service, to provide the Service on behalf of Orange, to perform services related to the Service or to assist Orange in analyzing how the Service is used. 

“Usage Data” refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).

Information You Provide Directly

We may collect certain personally identifiable information from You that You provide directly to us.  For example, You may provide us with information through:

  • Access to and use of any portion of the Service
  • Registration for an Account
  • Purchases of products and services from us
  • Communications with us, including for customer support, technical assistance, marketing and billing
  • Communications with other users of the Service
  • Participating in surveys, questionnaires, pools, sweepstakes, promotions or other similar opportunities we make available to You 
  • Providing us with voluntary feedback

The types of information we collect directly from You may include:

Account Registration Data.  If You register for an Account, we may collect Your email address, full name, phone number, address, bank account, credit card or other payment method information, device information, IP addresses and other log files, as well as how You interacted with the Service. You may also provide other information to us through Your Account, such as information about Your vehicle (e.g., make, model, color, etc.). or user content You upload to the Service, We may also create identifiers tied to your information, such as a device id tied to your phone. 

Charging Location Data. When You use a Charging Location as a Driver, we may collect information about Your charging session such as the Charging Location, date of the charging session, start time, end time, charging duration, energy dispensed, parking time, and charge fault information.  If You are the Owner of a Charging Location, we collect certain information from You such as contact information and Your affiliation with the Charging Location and associated Account with Orange. 

Customer Support Data.  If You contact us for customer support, we may collect case-related details and, in the case of telephone conversations, may record Your conversations.

Communication Data. If You engage with us regarding use of any portion or the Service, use any portion of the Service, or otherwise send an email or other communication to us (e.g., phone call, text, push notification, etc.), we may retain Your contact information and the related communication.

Payment Data.  We do not collect or store your credit card or other payment information.  All payment transactions are processed directly by our third-party payment processor, Stripe.  When you provide payment information, you are providing that information directly to Stripe, and your use of Stripe’s services is subject to their privacy policy, available at https://stripe.com/privacy. We may receive limited information from Stripe related to your transactions, such as your name, contact details, and confirmation of payment status. We use this information solely for purposes such as confirming your payment, delivering the Service, maintaining our business records, and complying with legal or accounting obligations. Stripe is responsible for the security of your payment information and you should review their privacy practices to understand how they handle your data.

Information We Collect Automatically

Usage Data.  When You use the Service, we and our third-party service providers may automatically collect Usage Data.

Usage Data may include information such as Your Device's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers online identifiers, standard HTTP header information, personal app information (first start, app opening, app update, in-app purchases, information on crash behavior of the app, crash information, bundle ID, device identifier, additional app information), links You have clicked on the Service, the page You visit before and after You come to the Service, operating system, language, diagnostic data, and other usage data including information on how You navigate the Service.

When You access the Service by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device unique ID, the IP address of Your mobile device, Your mobile operating system, the type of mobile Internet browser You use, unique device identifiers and other diagnostic data.

We may also collect information that Your browser sends whenever You visit our Service or when You access the Service by or through a mobile device. 

Location Data.  When You use the Service, we may collect information from which Your location could be derived (such as IP address). If You install our mobile application(s), we may ask You to grant us access to Your mobile device’s geolocation data. If You grant such permission, we may collect information about Your precise geolocation, in order to provide You with location-based features such as identifying Charging Locations available near You. If You access the Service through a mobile device and You do not want Your device to provide us with location-tracking information, You can disable the GPS or other location-tracking functions on Your device or disable GPS only for our application, provided Your device allows You to do this. See Your device manufacturer's instructions for further details. If You disable certain functions, You may be unable to use certain aspects of the Service.

Tracking Technologies and Cookies

We use cookies and similar technologies including web beacons, embedded scripts and e-tags (together referred to as “cookies,” unless otherwise stated) to provide You an efficient user experience in using the Service. A cookie is a small data file that is placed on your computer or mobile device by your web browser. It is a tool that stores information about website visits, recognizes You and Your preferences each time You interact with the Service, optimizes functionality, and enables us to provide our Service.

The Company may use Personal Data for the following purposes:

To provide and maintain our Service, including without limitation to monitor the usage of our Service and to protect against misuse.

For the performance of a contract: the development, compliance and undertaking of the purchase contract for the products, items or services You have purchased or of any other contract with Us relating to  the Service.

To contact You: To contact You by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile application's push notifications regarding updates or informative communications related to the functionalities, products or contracted services, including the security updates, when necessary or reasonable for their implementation.

To manage Your requests: To attend to and manage Your requests to Us.

With Owners:  We may share Your Personal Information with Owners of Charging Locations, for example when we provide invoicing and billing services to such Owners or when the Owner or a related party has agreed to cover the cost of Your charging sessions.

With Service Providers: We may share Your personal information with Service Providers to monitor or analyze the use of our Service, to advertise on third party websites to You after You visited our Service, for payment processing, to contact You, provide the Service, or to perform other services on our behalf, including as described under “Detailed Information on the Processing of Your Personal Data by Service Providers” below in this Privacy Policy.

For business transfers: We may share or transfer Your personal information in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition of all or a portion of Our business to another company.

With Affiliates: We may share Your information with Our affiliates, in which case we will require those affiliates to honor this Privacy Policy. Affiliates include any companies that control Us, that We control or that are under common control with Us, including any parent company, sister companies or subsidiaries, and any joint venture partners.

With business partners: We may share Your personal information with Our business partners to offer You certain products, services or promotions or when we offer products, services or promotions together with such business partners.

Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our Service. You can opt-out of having made Your activity on the Service available to Google Analytics by installing the Google Analytics opt-out browser add-on. The add-on prevents the Google Analytics JavaScript (ga.js, analytics.js and dc.js) from sharing information with Google Analytics about visits/activity.

Payments

We may provide paid products and/or services within the Service. In that case, we may use third-party services for payment processing (e.g. payment processors).

We will not store or collect Your payment card details. That information is provided directly to Our third-party payment processors whose use of Your personal information is governed by their Privacy Policy. Orange is based in the United States, and our Service is not marketed to or offered for sale outside of the United States and Canada. If you are a non-U.S. resident and provide us with your personal information, you acknowledge and agree that your personal information may be transferred to and processed in the United States, where the laws regarding processing of personal information may be less stringent than the laws in your country. By providing your information, you consent to such transfer and processing. If you believe that our processing of your information is inconsistent with your data protection rights and we have not adequately addressed your concerns, you have the right to lodge a complaint with the data protection supervisory authority of your country.

Children's Privacy

Our Service does not address anyone under the age of 13. We do not knowingly collect personally identifiable information from anyone under the age of 13. If You are a parent or guardian and You are aware that Your child has provided Us with Personal Data, please contact Us. If We become aware that We have collected Personal Data from anyone under the age of 13 without verification of parental consent, We take steps to remove that information from Our servers.
